What is a short sale?

There is more debt owed against a property than the property’s value.  In a loan default situation, (pre-foreclosure) the creditor(s) may be willing to agree to allow the property to be sold for less than the loan amount and/or accept less than (or “short”) the amount owed as payment in full.

Yes a short sale will impact your credit, but the impact might be less than a foreclosure and many lenders and potential employers are starting to look at folks who participated in short selling their homes differently than the folks who just walked away.  Your credit will more than likely show the account as settled for less than full balance, but at least you made the effort to work with your creditor to get them as much as possible for the house and outstanding debt.  We encourage and ask all of our clients to discuss with the proper professional regarding all the implications that go with a short sale, We ask that you consult with your Accountant and Real Estate Attorney regarding any tax or legal questions that you might have regarding what liability you might have for doing a short sale.  As we mentioned earlier, each case is unique and each client’s financial situation is different and needs to be evaluated by their financial and legal representatives.  If you do not have anyone we can refer you to several CPAs and Attorneys for your consideration.
